Mediation - In mediation proceedings, the parties to the dispute meet with a neutral third-party mediator. The mediator is there to facilitate discussion and cooperation between the parties to help them reach a fair settlement. It is always important to have an attorney advising you during mediation. If the other party proposes certain terms, our lawyers can advise whether the settlement could help or harm your interests or offer other available solutions to protect your rights.
Arbitration - During arbitration, each side will present its case to one or more neutral arbitrators. The arbitrator or panel will then review the arguments and make a decision on how to resolve the dispute. The parties agree to be legally bound by the decision. While arbitration may feel like a civil trial, the process can be less formal, much faster, and less costly than litigation. However, you must abide by the decision of a third party instead of negotiating an agreement.
